LEGALCLASS
TERMS &
CONDITIONS

This agreement sets out the terms and conditions that will govern the relationship between you (the student, or a parent/carer of a student) and Urban Strides Tuition LLP. It is a legally binding agreement. These rules are important to maintain standards and to ensure that all students and parents/carers gain the maximum benefit from their Urban Strides tuition.

1. Punctuality

1.1 The student attending the class is requested to arrive in good time. Entrance to classes may be prohibited to anyone arriving more than fifteen (15) minutes late.

1.2 Urban Strides’ duty of care for a child is only during the stated class times and on the condition that they adhere to the rules of behaviour and conduct given by the Instructor. Parents/carers must ensure they are punctual to collect a child at the class finish time.

2. Payment

2.1 The minimum class payment period is two [2] months. You must pay the monthly tuition subscription by Direct Debit for the minimum membership period unless your membership is terminated without liability, suspended or transferred in accordance with these terms.

2.2 Fees are calculated based on the number of classes scheduled during a year (this will differ depending on each class) and will be based on the academic school year. Payment for the classes is then spread over payments per calendar month (Discounted fees will vary). Class timetables and instructors are subject to change from time to time without notice.

2.3 We can suspend class membership during the minimum membership period if the student is unable to attend class for a period of one month or more due to unforeseen injury or illness. This will be attended to on a case by case basis and evidence of a doctor’s letter may be required.

2.4 If a payment is unable to be met by the due date the right to attend an Urban Strides class will be withdrawn until payment has been settled and brought up to date.

2.5 Interest is payable (whether before or after judgment) on any sums not paid when due at the rate of 4% p.a. above the base lending rate of HSBC Bank calculated daily. If late payment is settled by another payment method an additional nominal admin fee of £5 will be charged. If late payments persist you may have your tuition revoked.

2.6 Without prejudice to any other right or remedy that we may have, if you fail to pay us the Membership Fees on any due date we may raise a late payment charge if the debt remains unpaid after 7 days. Where such sum has been outstanding for more than 28 days, we may engage a collections agency to pursue you for the debt. You agree that you will be responsible for all costs of the agency seeking to recover payment from you.

2.7 At the end of the minimum membership period your membership will automatically continue unless either party cancels by giving the other at least one month’s notice.

2.8 During your membership, the monthly payment is payable, whether or not the student attends the class. No refunds are given for missed classes and fees will not be reimbursed retrospectively if the student stops attending classes, but fails to provide the required notice to cancel membership.

2.9 If you agree to undertake additional classes the additional costs will be added to your monthly payment.

2.10 Exchanging your class place to someone else is not permitted, but you may have the opportunity to transfer to another class at the discretion of Urban Strides Tuition LLP.

2.11 You may at times purchase additional classes, camps or workshops that you agree to the cost being added to your next direct debit deduction under the discretion of Urban Strides Tuition LLP.

3.1 CONDUCT

3.1 The Urban Strides student may be asked to leave by the Instructor if the student’s behaviour is deemed to negatively affect the educational experience of another student.

3.2 Each Instructor may have additional expectations of behaviour and conduct which the Urban Strides student, parent or guest are duty bound to adhere to.

3.3 Everyone at Urban Strides including but not exclusive to: Instructors, class assistants, head office staff, visitors, students and parents are to be treated with respect and politeness. Rude, aggressive or offensive comments will not be tolerated under any circumstances.

3.4 It is the responsibility of parents/carers and students to make themselves aware of the health and safety requirements at each venue and to comply with the venue’s rules.

3.5 Urban Strides operate a “No Tolerance” rule on the consumption of tobacco or alcohol at any of our class venues, or being under the influence of alcohol or illegal substances.

4.1 Liability

4.1 Agreeing to attend an Urban Strides class is declaration of your fitness to participate. If you are unsure as to your fitness to participate, please seek guidance from a medical professional. Urban Strides Instructors and assistants are not qualified medical professionals.

4.2 The liability of Urban Strides and that of its staff is restricted to class time only and then only to gross negligence.

4.3 To the extent permitted by law, our liability to you, save in respect of death or personal injury caused by our negligence shall be limited to the total amount you have paid for your membership.

4.4 Urban Strides staff are not liable for any loss, theft or damage of any property you choose to bring to class.

5. Class Cancellation by Urban Strides

No refunds will be given for any class which is cancelled due to unforeseen circumstances. In this situation we will endeavour to offer an alternative class.

6. Termination of Membership

6.1 We may terminate the student’s Urban Strides membership at any time if any of the rules of conduct or payment are breached.

6.2 You may terminate this agreement at any time without liability if the tuition the student is offered falls below, on more than one occasion, the standards reasonably expected to be provided.

6.3 This agreement may be terminated if either party is in serious breach of its obligations to the other.

6.4 Payment is due on the same date each month (depending on the 1st date of attendance at class) and cannot be changed. Payment must be made by direct debit and no other payment method is accepted. If payment of tuition fees is not made in full for any reason we reserve the right to suspend tuition and to exclude the student from Urban Strides classes.

6.5 A four week notice period is required for termination of membership and can only be given in writing to Urban Strides LLP, Suite 1, Logistics House, Chinnor Road, Bledlow, Princes Risborough, Buckinghamshire, HP27 9PH or by email to [email protected]. The time of receipt (not sending) shall be the time of commencement of the notice period. We will not accept liability for mail/email lost in transit and therefore suggest a proof of receipt is obtained at time of posting or emailing.

6.6 It is not sufficient to simply cancel the direct debit instruction or inform the Class Instructor at class that you wish to cancel membership.

6.7 If a monthly payment falls due within the 4 weeks’ notice period, the full monthly payment is due. Customers should therefore be aware of their payment due date when sending notice of cancellation. No partial refunds will be made.

6.8 Students may continue attending their class during the 4 weeks’ notice period if they wish to.

6.9 On application to terminate your Membership Contract for any reason you shall immediately pay to us all outstanding Membership Fees.

7.1 We reserve the right to use any individual or group photographs or video shots of all Urban Strides students (both under 16 and over) for press or promotional purposes. If you have any issues with this, please inform the Class Manager in writing before the start of your or your child’s first class.

7.2 All children attending our Junior classes must be collected from the class room by their parent/carer. If you wish to authorise anyone else to collect your child, or you would like your child to meet you in the car park at the class venue, please send confirmation by email to [email protected]. If any provision of the Contract (or part of any provision) is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed not to form part of the Contract, and the validity and enforceability of the other provisions of the Contract shall not be affected.
